  1. Account Registration
    • You must provide accurate and complete information when registering for an account.
    • You are responsible for maintaining the confidentiality of your account credentials.
    • You are responsible for all activities that occur under your account.
  2. Who We Are

    We provide a platform where users can create, upload, and sell acoustic backing tracks. We do not own the content uploaded by users, but we provide the technical infrastructure to host, display, and facilitate sales.

  3. Eligibility

    You must be at least 18 years old or the age of majority in your country to use this site. You are responsible for maintaining the confidentiality of your account credentials.

  4. User Content and Responsibility
    • You own the content or
    • You have obtained the appropriate licenses to use, upload, and sell the content (e.g., mechanical licenses for cover songs).
    • You are solely responsible for the content you upload, including ensuring it does not infringe on any third-party rights.
    • You grant us a non-exclusive, worldwide licence to host, display, and sell your content as part of our platform’s functionality.
  5. Commission-a-Musician Service

    Our platform offers a service allowing users to privately commission musicians to record custom acoustic backing tracks. This service is distinct from public sales and operates under the following terms:

    • Musicians are compensated for their performance and time, not for licensing or resale rights.
    • Commissioned tracks are intended for private use only and are not publicly distributed on the platform unless explicitly agreed upon by both parties.
    • This service is exempt from standard music licensing requirements applicable to public distribution, as it constitutes a private commissioned work.
    • It is the responsibility of the commissioning user to ensure they have the legal right to commission the work, including securing any necessary permissions to record or use the underlying song.
  6. Licensing for Artists
    1. Originality and Rights: You must be the original creator of the backing track you upload, or you must have the legal right and permission to distribute it.
    2. Securing Licenses: You are solely responsible for securing any necessary rights, including but not limited to:
      • Mechanical licenses for cover songs.
      • Arrangement rights, where applicable.
      • Permissions from original copyright holders, if the track is based on existing copyrighted works.
    3. Warranties: By uploading a track, you confirm and warrant that:
      • You have all required permissions to distribute the track through our platform.
      • The track does not infringe any third-party copyrights, trademarks, or other rights.
    4. Platform Policy: Acoustic Version UK does not verify licenses for uploaded tracks and assumes no responsibility for rights violations committed by users. We reserve the right to remove or disable access to content in response to valid copyright complaints, in accordance with our Terms of Service and applicable copyright law. You, the uploader, bear full legal responsibility for the content you submit.
  7. Copyright Infringement

    We respect intellectual property rights. Upon receiving a valid notice of copyright infringement, we may:

    • Remove or disable access to the infringing content,
    • Suspend or terminate accounts of repeat infringers, and
    • Cooperate with rights holders as legally required.

  8. Prohibited Content and Activities
    • You may not upload infringing, illegal, defamatory, or harmful material,
    • Misrepresent ownership or rights to any content,
    • Attempt to exploit or hack the platform, or
    • Circumvent payment systems or mislead users.
  9. Payments and Commissions
    • Payments are processed securely via Stripe.
    • We may retain a commission from each sale, as described on our pricing or FAQ pages.
    • You are responsible for reporting and paying any taxes related to your earnings.
  10. Data Handling
    • We use Amazon S3 for secure file storage.
    • Passwords are securely hashed and never stored in plain text.

  11. Account Termination
    • We may suspend or terminate your account at our discretion, especially in cases of:
      • Copyright infringement,
      • Violation of these Terms,
      • Fraud, abuse, or suspicious activity.
  12. Limitation of Liability
    • To the fullest extent permitted by law, we shall not be liable for:
      • Indirect or consequential damages,
      • Loss of earnings, data, or reputation, or
      • Content uploaded by users.

    You use this platform at your own risk.

  13. Licensing

    All backing tracks available on Acoustic Version UK, whether uploaded by users or commissioned through our platform, are licensed only for private, personal, and home use.

    Any use of these tracks for public performances, broadcasts, commercial purposes, or public distribution requires you to obtain the appropriate licenses or permissions from the relevant copyright holders.

    Acoustic Version UK does not grant any public performance or commercial usage rights and is not responsible for unauthorized use beyond private or personal listening and practice.

    It is your responsibility to ensure that you have all necessary rights and licenses for your intended use of any track obtained through our platform.

    Ownership of Content

    All backing tracks uploaded to Acoustic Version UK remain the sole property of the artist or user who uploaded them. By uploading content, you retain your ownership rights but grant Acoustic Version UK a non-exclusive license to host, display, and distribute the content as necessary to provide the platform’s services.

  14. Governing Law and Jurisdiction

    These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

  15. Changes to These Terms

    We may update these Terms at any time. If material changes are made, we will notify users via the platform or email.
